Parking Ticket Appeal

There are millions of parking tickets issues every year and only a faction of these cases are contested but there are also some strong evidences which many drivers bring along to beat the fines places on them. This means that are surely possible ways to successfully file a parking ticket appeal when you follow all the strict regulations. So, when you receive a parking ticket or a penalty charge notice then you either have the choice of paying within the 14 days period during which the fine price is halved or you can even appeal the parking ticket. The size or amount in the fine might vary depending on the office being committed. Therefore in order to appeal the parking ticket you first have to send a letter to the council which explains that you need to challenge the ticket being given also the reason why.

What you should know about parking ticket appeal


You should know that this is probably the last chance you have to pay the ticket at half price. In case you wish to write an appeal letter to the council then the process might take you over 14 days and the fine would be double the amount. However you can even request the fine to be frozen at its lower price until appeal is resolved but there are least chances the council would grant you this benefit. In case you are not confident of your parking ticket appeal then it would be wise to pay the fine within the 14 day period. The council might either accept your challenge or withdraw fines placed on you or they might also reject it. In case the council rejects your challenge then they would send you a form called notice to owner through which you can make the formal representations. You are then given the 14 days period to make this representation and it is also the period when you can determine why the ticket must be canceled.

Moreover the council can accept the representation and also drop the fine or they can also reject them. Therefore during such cases they would send you a notice of rejection for the representation along with the appeal notice form. You will then have a period of 28 days to lodge appeal with parking adjudication service which is entirely different from the council who would make decision on your case. You should know that the fine could be increased by nearly 50 percent in case you fail in the parking ticket appeal.

The reasons why you can file parking ticket appeal


There are some legal grounds or reasons why you can file the appeal for parking ticket and the appeal should also be included in any of the categories. The reasons are:
  • The dispute did not occur which can cover misleading signs, loading, non visible markings or signs, in valid permit or parking voucher being displayed and if the ticket was not issued.
  • The order of traffic regulation was invalid which only applies when the authorities’ regulations are defective legally.
  • The penalty goes beyond the applicable amount.
  • You were not the holder of the car when suspected breach occurred.
  • You area car hire company and have supplied the name and address of the hirer.
  • The vehicle was taken without your approval when the alleged contravention occurred.

It’s not your vehicle


This reason is quite straightforward in which case the fines which are directed to the actual owner of the car. However the cars which have been recently sold or purchased the notice would be sent to the person who is registered as the owner as mentioned in the driving and vehicle licensing authority. In case you have recently sold your vehicle then the buyer might not have updated the registered owner in which case you should do it. When you appeal a parking ticket on this grounds you will have to provide sufficient contact details of the person who purchase the vehicle from you or the one who sold it to you.

Your car was stolen


In case you are appealing on the grounds that your vehicle had been stolen when the ticket had been issued then you will generally be required to present a crime reference number when making an appeal .

The file exceeds the regular amount


In case you are fined by a parking attendant and not a private company then the penalty would generally be around $40 which drops to $20 when paid within 14 days period but is also depends on the nature of offence. Therefore in case your parking ticket exceeds the regular amount you can immediately phone the council to find out if there is any reason why your ticket includes higher amount. When the fine amount exceeds the normal amount applicable in your area then you are allowed to appeal.
